The evolutionary interpretation of the constitution

From the terminological perspective, the Constitution performs a neutral treatment of gender, based on the values of dignity and formal and material equality and the right not to be discriminated against. The guarantee of gender identity is projected on the different areas of individual life: individual autonomy, sexuality and physical integrity, social and professional activity in the scope of public administration and political participation. In this paper, the most relevant aspects of the constitutional jurisprudence on gender are exposed and the importance of the rule of the evolutionary interpretation of the Constitution to deal with the challenges derived from the evolution of society and its legal treatment is highlighted.
