Abstract

In STC 25/2019, the TC analyzes the conflict that occurs between freedom of information and the rights of art. 18.1 CE when using hidden cameras. To resolve this conflict, it is necessary to carry out a stricter proportionality judgment than in the other cases. In any case, and as a general rule, the CE prohibits the journalistic use of this instrument as it constitutes a serious violation of the fundamental rights to privacy and self-image.
