The control exercised by courts over the normative creation by caretaker governments

This paper examines the judicial control over the normative creation by caretaker governments in Spain. It addresses the issue of the competencies and limitations of a caretaker government, particularly regarding its normative capacity. In this regard, it will be noted that the jurisprudence of the Supreme Court, which establishes that caretaker governments must limit themselves to the ordinary administration of public affairs (except in cases of urgency or duly justified general interest), is widely accepted and applied. The publication of this paper is justified by its contribution to understanding the legal and constitutional limits of caretaker governments, providing a significant advance in the interpretation and application of current regulations.
