Abstract
The article examines the constitutional characteristics of jurisdictional power in the Spanish legal system, highlighting its conceptual precedence over the Judiciary. It explores how the Spanish Constitution adopts an adversarial approach to jurisdictional power, defining its scope in relation to effective judicial protection, administrative oversight, and the imposition of penalties. The relationship between jurisdiction and administration, procedural guarantees, and the tensions arising from the separation of powers are also addressed. The text concludes by emphasizing the significance of irrevocability as a key element to ensure legal certainty.
