The confict between freedom of expression and the right to honor in social networks. Violation of the right to honor of a deceased bullfighter: the case of Víctor Barrio Hernanz (STC 93/2021)

Abstract

The object of this comment is STC 93/2021, of May 10, in which the TC resolves for the first time the conflict between freedom of expression and the right to honor in the field of social networks. For the highest Court, the fact that opinions are expressed through a social network does not require a specific prosecution canon and, therefore, resolves the conflict through the existing classical jurisprudence in this regard.
