Abstract

The purpose of this article is to introduce the Polish Constitutional Court to the Spanish reader. This was, after the Constitutional Court of Yugoslavia, the second jurisdiction to be set up in the former European communist bloc before its collapse. Its genesis dates back to 1982 when the then-current Constitution of the People's Republic of Poland of 1952 was amended. After the first Law on the Constitutional Court was approved in 1985, the Supreme Guardian of the National Magna Carta began to work at the beginning of the following year.

After a brief historical overview of the body in question, I will examine its model as designed by our legislation, its organization, powers and procedures. I will end with some comments on the rulings of the Polish Constitutional Court and their effects.
