Abstract

This article analyzes the jurisdictional conflict between the autonomous communities of Castilla y León and Castilla-La Mancha, resolved by Constitutional Court Ruling 44/2007, regarding the regulation of the geographical indication "Vino de la Tierra de Castilla." The dispute arose from Castilla-La Mancha's use of the term "Castilla," which Castilla y León considered an infringement of its competences. The Constitutional Court ruled that there was no breach of the distribution of powers or the principle of autonomy, rejecting the positive conflict of competence. However, a dissenting opinion pointed to a potential violation of Article 147.2 of the Spanish Constitution.
