Once again, the electoral system of Castilla-La Mancha before the Constitutional Court
commentary on STC 19/2011
Abstract
This document examines Constitutional Court ruling STC 19/2011 regarding the electoral system of Castilla-La Mancha, focusing on challenges to Law 12/2007. This reform increased the number of regional assembly seats by two, allocated to the Toledo and Guadalajara constituencies. Plaintiffs claimed violations of proportionality, equal suffrage, and the prohibition of arbitrary actions by public authorities. The Court upheld its precedent of flexible interpretation concerning proportionality and equality, emphasizing the objective and reasonable basis of the regional legislature's decision. The paper concludes with reflections on the democratic implications of unilateral electoral law amendments.
