Agricultural subsidies and aids before the Constitutional Court again
Commentary on STC 99/2012, of May 8
Abstract
This article examines the Constitutional Court Judgment 99/2012, which resolves a jurisdictional conflict between the State and Castilla-La Mancha concerning Royal Decree 117/2001 on agricultural subsidies and aid. The regional government challenged the national regulations, claiming they encroached upon autonomous competencies in agriculture and livestock. The Constitutional Court concluded that while the State can establish basic guidelines for economic planning, it must respect the regional autonomy framework. The judgment also addresses procedural issues, such as single calls and publication requirements, confirming their constitutionality under the General Subsidies Law.
