Medical liability arising from negligence in prenatal diagnosis: "wrongful birth" and "wrongful life" actions. Impact of the proposed law for the protection of the life of the unborn child

The Medical Science advance, particularly in the field of prenatal diagnostic techniques, which allow the genetic malformations detection in embryo and fetus, and the wide spread of legal abortion to safeguard the pregnant interests, have promoted the appearance of those lawsuits (wrongful birth and wrongful life) filed by parents or child against medical professionals and public and private institutions where they perform their work when a child is born with such a congenital defect that could have been detected during pregnancy, within the deadline legally established to interrupt it, and however they weren’t reported or were incorrectly reported about such genetic anomaly.
This research aims to provide a complete view of the origin and evolution of wrongful birth and wrongful life actions, and illustrate its practical applicability in the Spanish legal system, especially after the changes promoted by the projected Law of Conceived Life Protection.
